User Agreement

By submitting an exchange request, the User confirms that they have read this Agreement in full and unconditionally accept its terms.

1. General Provisions

This User Agreement (hereinafter — the “Agreement”) governs the relationship between Paspar.Net (hereinafter — the “Service”, “Provider”) and an individual (hereinafter — the “User”, “Client”) using the Service’s cryptocurrency and digital asset exchange services.

This Agreement constitutes a public offer. The act of submitting an exchange request signifies the User’s full and unconditional acceptance of all terms of this Agreement without any exceptions or limitations.

The Service reserves the right to amend this Agreement unilaterally. The current version is always available on the website. Continued use of the Service following any amendments constitutes acceptance of the updated version.

2. Terms and Definitions

  • Service / Provider — Paspar.Net, providing cryptocurrency and digital asset exchange services.
  • User / Client — a legally competent individual aged 18 or over who has accepted the terms of this Agreement.
  • Request — an electronic exchange order submitted by the User through the Service’s interface.
  • Exchange Transaction — an operation converting cryptocurrency, fiat funds, or digital assets at the rate applicable at the time of submission.
  • Exchange Rate — the value ratio of the assets being exchanged, fixed at the moment the request is confirmed.
  • Payment Details — a cryptocurrency wallet address, bank card number, e-wallet account, or other payment information provided by the User when submitting a request.
  • AML Check — a procedure for verifying the origin of funds in accordance with the anti-money laundering policy.

3. Subject of the Agreement

The Service provides the User with exchange services for the following types of assets:

  • Cryptocurrency → Cryptocurrency
  • Cryptocurrency → Fiat funds (bank cards, bank transfers)
  • E-wallets (Volet, AdvCash, and similar payment systems)

The Service acts as an intermediary, providing the technical capability to conduct exchange transactions. The Service is not a financial institution, bank, or payment organisation.

4. Exchange Transaction Procedure

4.1. Submitting a Request

To carry out an exchange transaction, the User completes the request form on the website, specifying: the exchange direction, amount, and payment details for the credit of funds, and confirming acceptance of this Agreement and the AML/KYC Policy.

4.2. Rate Lock

The exchange rate is locked at the moment the request is confirmed by the Service. The Service reserves the right to adjust the rate in the event of significant market fluctuations during the period of waiting for the User’s funds to arrive.

4.3. Receipt of Funds

After submitting a request, the User is required to transfer the specified amount to the Service’s payment details within 20 minutes. After this period expires, the request is cancelled.

If funds arrive at the Service’s payment details after the request has been cancelled, the amount payable to the User may be recalculated at the current exchange rate applicable at the time of recalculation. If the rate has changed by more than 1%, the recalculation of the payout amount is carried out only with the User’s consent. If the User does not accept the new rate, the received funds are returned less network/systеm fees.

4.4. Processing and Payment

All incoming funds from the User are credited to the Service’s account automatically. Fiat transfers to the User’s payment details are processed manually. The standard processing time is up to 2 working hours during business hours. In exceptional cases, the timeframe may be extended to 24 hours.

Amount discrepancy: if the amount received at the Service’s payment details differs from the amount stated in the request (regardless of the size of the discrepancy), the Service automatically recalculates the payout amount to the User in accordance with the current exchange rate at the time the funds are received.

5. Service Fees and Commissions

The Service’s fee is included in the exchange rate and is displayed to the User before the request is confirmed. Additional blockchain network or payment systеm fees are charged separately and are indicated at the time of placing the request.

When funds are returned at the User’s request or as a result of a cancelled request, actual transfer commission costs are deducted from the refund amount. Current refund commission rates are available at the bottom of this page.

6. AML/KYC Policy and User Obligations

The Service verifies transactions in accordance with anti-money laundering (AML) and counter-terrorist financing (CFT) legislation. Detailed verification terms are set out in the AML/KYC Policy.

By submitting a request, the User confirms that they:

  • are a legally competent individual aged 18 or over;
  • are the lawful owner of the funds being exchanged;
  • the funds were obtained legally and are not connected to money laundering, terrorist financing, or any other unlawful activity;
  • have read the Service’s AML/KYC Policy and accept its terms;
  • are not a person listed on any sanctions lists (OFAC, EU, UN, UK, or other internationally recognised sources).

Important: The Service reserves the right to suspend or block a transaction and request identity and source-of-funds verification (KYC/SoF) if a transaction raises suspicion. Should the User refuse to provide the required documents, funds may be frozen for up to 30 business days.

7. Confidentiality and Data Protection

The Service collects and processes Users’ personal data solely for the purpose of executing exchange transactions and complying with AML/CFT legislation requirements. Data processing is carried out in accordance with the Privacy Policy and GDPR requirements.

The User consents to the processing of their personal data, including the transfer of technical data and wallet addresses to third-party AML analysers for the purpose of verifying the origin of funds.

8. Liability of the Parties

8.1. Service Liability

The Service is liable for the timely execution of confirmed requests within the limits set by this Agreement. The Service is not liable for:

  • losses resulting from incorrect payment details provided by the User;
  • delays caused by technical failures in blockchain networks or third-party payment systems;
  • cryptocurrency rate fluctuations during the processing of a request;
  • consequences of User actions that violate the terms of this Agreement.

8.2. User Liability

The User bears full responsibility for:

  • the accuracy of the payment details and information provided when submitting a request;
  • the legality of the origin of the funds being transferred;
  • any losses incurred by the Service as a result of the provision of false information or fraudulent actions.

9. Prohibited Transactions

Use of the Service is strictly prohibited for:

  • money laundering and the legalisation of proceeds of crime;
  • financing of terrorism and extremist activities;
  • transactions involving sanctioned individuals or organisations;
  • fraud, scams, and other unlawful financial schemes;
  • circumventing AML/KYC requirements through payment splitting or other manipulations.

Upon detection of prohibited transactions, the Service will immediately freeze the funds and refer the matter to law enforcement authorities.

10. Refunds

Refunds are made exclusively to the sender’s original payment details. Refunds to third-party details are not permitted.

Grounds for a refund:

  • cancellation of a request upon expiry of the waiting period;
  • inability to execute a request due to technical reasons;
  • blocking of a transaction following an AML review upon confirmation of the legitimacy of the funds.

Refunds are processed within 1 business day of the decision being made, less actual network/systеm fees. In the event of an AML block, the timeframes and conditions set out in the AML/KYC Policy apply.

11. Force Majeure

The Service is released from liability for non-performance or improper performance of its obligations where this is caused by circumstances beyond its reasonable control, including blockchain network failures, cyberattacks, regulatory actions, natural disasters, and other events outside the Service’s control. The Service will notify the User of any force majeure circumstances within a reasonable timeframe.

12. Right to Refuse Service

The Service reserves the right to decline a request or terminate the Agreement unilaterally without explanation, including where:

  • the transaction violates AML/CFT legislation requirements;
  • the User refuses to undergo the KYC/SoF procedure;
  • there are grounds to believe that the funds were obtained unlawfully.

13. Claims and Dispute Resolution

Claims relating to the execution of requests are accepted within 72 hours of the expiry of the estimated transaction completion time. Claims must be submitted to the Service’s support team, including the request number, a description of the issue, and supporting documents.

The Service will review the claim within 10 business days and notify the User of its decision.

Disputes not resolved through the claims procedure shall be settled in accordance with applicable law.

14. Final Provisions

This Agreement enters into force upon the User’s confirmation of the exchange request and remains in effect until both parties have fully discharged their obligations.

If any provision of this Agreement is found to be invalid, the remaining provisions shall retain full legal force.

For all matters not governed by this Agreement, the parties shall be guided by applicable law and the Service’s internal policies: the AML/KYC Policy and the Privacy Policy.

By submitting an exchange request, the User confirms that they have read this Agreement, understand its terms, and accept them in full.
